Account & Security

To become a customer of Farm Fresh Direct you must create an account with us and provide us with correct and complete details. If these details change at any time then you must update your account in the Account area before ordering any further goods. You must over 18 years of age.

When you register to use Farm Fresh Direct you will be asked to create a password which you must keep confidential and must not disclose it or share it with anyone. You will be responsible for all activities and orders that occur or are submitted under your password, if you know or suspect that someone else knows your password you should notify us and change it immediately. If Farm Fresh Direct believes there may be a breach of security we may require you to change your password or we may change it for you.

Payment

You will be required to pay for goods and services ordered through Farm Fresh Direct by credit or debit card through our Secure Trading Account.

The personal and payment details you give us are governed by a strict privacy policy, please read this document in conjunction with these terms and conditions.

All payments for orders must be paid using a debit or credit card when making an order. We do not accept any other form of payment.

Your credit card and payment details will not be held on our system. You will be asked to enter your card details every time you make a transaction. These card details will be handled by secure trading. Whilst we take security extremely seriously we accept no liability for misuse of card details amounting from the use of Farm Fresh Direct.

We reserve the right to terminate our agreement with you if we are refused authority from your card issuer for payment or we reasonably believe that payment will be refused.

If a payment has been rejected by your bank, you will not be able to amend, cancel or add to your orders via our website. Your order will be erased unless you can supply an operational card, with full authorisation.

Your bank will be asked for payment when we process your order and authorise your payment. This will usually be on the day prior to your booked delivery.

Orders

You must be over 21 to purchase alcohol through Farm Fresh Direct and if you cannot receive it when we deliver it is your responsibility to ensure there is a suitable recipient available.

You may submit orders by using our online ordering facility at any time. Farm Fresh Direct allows you to review your order and make any corrections before submitting it to us and by submitting the order you confirm that you have made any such corrections. Each product for which you click 'Add to basket' is added to a shopping basket facility. You are given the opportunity to review the basket prior to checkout. You can change or cancel the purchase of the products completely at this stage or at any time before by clicking on 'Proceed to Checkout' or using the 'Shopping Basket' preview screen on the product pages You can also book your preferred delivery slot at any time however this must be booked prior to payment. Once you have clicked into the 'Checkout' you will be asked to supply card details for electronic payment of your order. Once payment has been taken you may review your order but you may not be able to make any changes to it.

Your submission of an order amounts to an offer to enter a contract to buy the products from us; you cannot then withdraw or cancel your order.

No order is accepted from you until our website displays an order confirmation page displaying that your order has been successful. This message is displayed after you click your card transaction has been successful.

Where we accept an order we do all that we can to ensure your order is fulfilled; products are however subject to availability and market conditions and we do not always know if a product is or will be available at the time of accepting an order. If we are unable to deliver an item you have ordered, we may offer a reasonable replacement or reimburse your card for the due amount. You may reject the substitute and you will not be charged for it. We bear no responsibility for unavailability of products.

You are entitled to cancel a payment for products where fraudulent use has been made of your payment card by a person not acting, or to be treated as acting as your agent. If you have made a payment where your card has been so fraudulently used, then you should approach your card issuer for re-credit to your card.

Our products are not for resale.

Prices

All products offered by us are subject to occasional change in price. This is particularly likely with fruit and vegetables which are subject to seasonal changes in supply levels and supply prices. Farm Fresh Direct will endeavour to inform you of any changes to the price or availability of items in our range, however we reserve the right to change our prices and products without notice to reflect such changes. Current prices will always be shown in the catalogue section of our website. We will only charge you the price that is displayed on the website on the day and time your delivery is due. All prices will be inclusive of any applicable VAT.

All prices shown for items on the site and on order confirmations are guide (approximate) prices. Because orders are individually prepared, it can be expected that there may be some small variation in weights above or below the weight you choose, the price you pay will be for the actual weight delivered to you. Unless there has been a price change (see above) we will ensure that this variation never exceeds more or less than 10% of any item specified. Items delivered within 10% of the guide price ordered shall be deemed acceptable by you and complete.

Acceptable Weight Variation

All weights shown, except for pre-packaged goods, are guide (approximate) weights. When you place your order, it will be for a nominal weight of produce, at a specified price. We will collect the payment via the payment method you select when placing the order. Because orders are individually prepared, it can be expected that there may be some small variation in weights above or below the weight you choose, you will be charged for the actual weight delivered to you. We will ensure that this variation never exceeds more or less than 10% of any item specified. Items delivered within 10% of the weight ordered shall be deemed complete.

Delivery

We will make the delivery to the delivery address you state when your order has been placed. We reserve the right not to deliver to all locations. You are responsible for making suitable arrangements to receive your delivery and giving us appropriate instructions when making the order. In the event that your delivery is stolen from your doorstep or damaged while there, we do not accept liability and will offer compensation at our discretion. We reserve the right to refuse to accept orders from any customer; considerations of delivery problems may give rise to such a refusal.

We endeavour to keep your delivery day and time slot the same, but we reserve the right to change it temporarily or permanently and will tell you if we do so.

If we are unable to deliver to you, or have to deliver late for reasons beyond our control, for example adverse weather conditions, strike actions, vehicle breakdown, traffic congestion or supplier failure, we cannot accept any liability for any inconvenience or loss that this causes. We will reimburse you for goods which are not delivered to you.

We will not charge you for incorrect products ( products that you have not ordered and which are not reasonable substitutes for those products) or products we have not delivered in accordance with these Terms and Conditions. Otherwise our liability is limited to the price of the incorrect products or the products not delivered.

You must inspect the products as soon as possible after delivery and notify us promptly if you find any defects. We will replace or refund you for any defective products.

Packaging for delivery.

You may rest assured that we have taken great care to ensure your goods arrive in best condition. We will deliver directly from our farm store to your door in one of our own refrigerated vehicles and relevant produce is vacuum packed in a food-safe polythene pouch and stored during delivery at a temperature of less than 5 degrees centigrade.

Intellectual Property and Copyright.

All the materials available on Farm Fresh Direct are the property of Farm Fresh Direct Ltd and are protected by copyright except when acknowledged to be the work of other parties. The site is provided solely for your personal use. You may not use Farm Fresh Direct or the materials available on the Site in a manner that constitutes an infringement of our rights or that has not been authorised by us. Unless explicitly authorised by the owners you may not modify, reproduce, copy, republish, post, translate, create derivative works, sell, or distribute in any manner or medium any material from the Site for gain or otherwise. Permission is granted to electronically copy and to print hard copy portions of the site for personal and private use as an informational resource provided all copies retain the copyright and any other proprietary notices contained on the materials.

Termination

We reserve the right to terminate your right to use or access to Farm Fresh Direct at any time without notice. If your rights to access the Site have been terminated you are no longer authorised to be a User of the Site or use it in any capacity.

You can cancel your registration with us at any time by informing us either in writing or by email.

The suspension or cancellation of your registration shall not affect either parties rights or liabilities accrued to the date of termination or any orders submitted by you before we received notice of your cancellation, and you will continue to be bound by such orders.

All other provisions of these Terms and Conditions shall survive cancellation.

Farm Fresh Direct is provided “as is” without any warranties or guarantees save those set out in these Terms and Conditions.

Liability

Under no circumstances including but not limited to negligence, shall we be liable for any direct, indirect, incidental, special or consequential damages that result from the use of, or the inability to use Farm Fresh Direct including its materials or services made available through this site. You acknowledge and agree that we are not liable for any offensive, defamatory or illegal conduct of any user. If you are dissatisfied with the site or with and of the terms and conditions in this agreement your only remedy is to discontinue use of it.

Farm Fresh Direct tries to ensure that material included on the Farm Fresh Direct is correct, reputable and of high quality, we cannot accept responsibility if despite our endeavours this is not the case. Farm Fresh Direct will not be responsible for any errors or omissions or for the results obtained from the use of such information or for any technical problems you may experience. Farm Fresh Direct will endeavour to change any such inaccuracies as soon as it is made aware.

By creating an account with Farm Fresh Direct you agree that we hold no liability for any loss of revenue, loss of profit, loss of anticipated savings, loss of business or wasted expenditure (whether direct, consequential, incidental or indirect); consequential or indirect damages or any other loss or damages that arise out of or are related to Farm Fresh Direct.

We accept no liability for the loss of personal data.

We shall not be liable for any delay or failure in the performance of our obligations due to events beyond our control such as but not limited to fire, flood, adverse weather, acts of God, strikes, labour disputes, riots, civil unrest, accident, disruption to energy supplies, equipment or supplier failure, road traffic problems, terrorism or war.

Farm Fresh Direct may include links to other websites or other material which is beyond our control and therefore Farm Fresh Direct accepts no liability for their content.

These Terms and Conditions shall be governed by and construed in accordance with the laws of England and The English courts have non-exclusive jurisdiction over any disputes arising under or in relation to these Terms and Conditions.
